ADVICE TO PROSPECTIVE PURCHASERS


The developers of "The Gilbertson Industrial Estate", Marwen Properties Pty Ltd, have worked closely with Council to create what they believe will be the most desirable Estate of its type.  To protect purchasers there are controls provided by the Planning Scheme, the specific Planning Permits for the site and "The Development Guidelines".

All purchasers must ensure that the controls are suitable to their intended use and this summary has identified some of the key issues to consider from the Planning Permits and "The Development Guidelines".


            The Planning Permit

Conditions 3 & 27  Every Title will be effected by one or more Section 173 Agreement.

Conditions 4 & 7  An archaeological survey and a flora and fauna survey have been undertaken.

Condition 18   Development Guidelines have been proposed and effect the design and use of lots on the plan.

Conditions 19 & 20  There are access restrictions to surrounding roads.

Notes:

  • Access on Boundary Road, Fitzgerald Road and Mt Derrimut Rd is controlled.
  • The permit is for subdivision only, not use and development.

The Development Guidelines

Paragraph 4

  • A development plan must be prepared for any Town Planning Application.
  • Not more than 2 crossovers are permitted on any allotment except on corner lots where a third one will be allowed.
  • Landscaping and its maintenance are an important feature of the development approval.
Paragraph 5
  • Buildings are to address the road frontage/frontages.
  • Fencing types and location are regulated.
  • Any walls facing the Western highway - Western Ring Road connection must be articulated.
  • The minimum Lot size is 1 HA unless in a precinct created by the developer with the approval of the Council.
  • Roof mounted equipment must be screened.
  • The minimum setback is 20 metres except for minor intrusions and architectural features - 5 metres (other than frontage)
  • Car parking must be set back at least 9.5 metres
  • The choice for plants for landscaping is restricted
  • The control of noxious weeds is a maintenance issue for Lot owners

  • Hazardous goods and chemicals must be appropriately stored and controlled
  • The external finishes, sealing of surfaces, and the maximum height of the buildings are restricted and must be detailed and approved
  • All fences are to be black cyclone
  • Colours are to be subdued except for corporate identity
  • Driveways must adequately accommodate vehicles, manoeuvring of semi-trailers and on the larger Lots double-b vehicles
  • Provision for unloading of vehicles and storage of goods and waste must be made within the site and in screened areas
  • Lighting is required for security and to compliment the character of the building but must be appropriately directed and baffled
  • All sites must be kept in a clear, safe and tidy condition.
